As of May 25, 2025, the Federal Housing Administration (FHA) is tightening its rules around who qualifies for an FHA-insured mortgage.
Here’s the key change:
Non-permanent residents will no longer be eligible for FHA loans—even if they currently have valid work visas and legal authorization to live and work in the U.S.
This includes:
- H-1B visa holders (skilled workers)
- L-1 visa holders (intra-company transfers)
- O-1 visa holders (individuals with extraordinary ability)
- And others with temporary, employment-based status
Also ineligible:
- Asylum seekers without USCIS Form I-94
- Anyone who is not a permanent resident or U.S. citizen—even if they have steady jobs, good credit, and a strong rental history

Over the years, we've worked with buyers from all walks of life—many of whom are here legally, working hard, building businesses, and contributing to their communities. One couple that we are helping right now —Ukrainian refugees who fled the war and resettled in our area. The Russian military are now occupying their former home in Ukraine. Despite the trauma they’ve experienced, they’ve moved forward with incredible determination and resilience.
They’ve since launched two small businesses, are renting one of our properties, and were excited to begin the process of buying a home. We connected them with a lender, and we're currently gathering the documentation needed to show income and qualify them—no easy feat for self-employed newcomers still establishing a financial history. FHA loans have traditionally supported buyers with limited down payments who are working to establish financial stability. Under the new rules, some applicants may no longer qualify—not due to their financial profile or credit history, but because of changes in how immigration status is classified.
Who Can Still Get an FHA Loan?
The FHA has clarified that the following borrowers are still eligible:
- U.S. Citizens
No change—FHA remains an option if you meet the usual credit and income criteria.
- Lawful Permanent Residents (Green Card holders)
You’re still eligible if you:
- Provide valid proof of residency (Form I-551, your green card)
- Indicate “Permanent Resident Alien” on your loan application (URLA)
- Citizens of Certain Pacific Island Nations
Specifically:
- Federated States of Micronesia
- Republic of the Marshall Islands
- Republic of Palau
You’ll need to provide official documentation showing your citizenship from your home country.
❌ Who No Longer Qualifies?
If you’re in any of these categories, FHA loans will no longer be available after May 25:
- Non-permanent residents on work visas like H-1B, L-1, O-1—even with legal work authorization
